PARKER PROPERTY GUIDE

Property knowledge, made clear.

A practical Thai–English guide to help you ask the right questions before renting, buying or selling property in Thailand.

LAND DOCUMENTS

Common land documents in Thailand

The document type affects ownership, boundaries, transfer and permitted use. Always have the original document and current Land Office record checked before entering into an agreement.

Chanote ·

The strongest form of private land title. The registered owner may generally sell, transfer, mortgage or lease the land, subject to law, planning controls and any registered encumbrances.

Certificate of Utilisation

Evidence that the land has been put to use. It is generally transferable, but it is not the same document as a Chanote. Boundary and survey checks remain essential.

Certificate of Utilisation

An older certificate of utilisation with less precisely surveyed boundaries. Transfer procedures may require public notice and careful confirmation at the responsible Land Office.

S.P.K. 4-01 · ส.ป.

Agricultural Reform Land

Land allocated for agricultural use under land reform rules. It is not an ordinary freehold title and cannot be freely bought and sold like Chanote land. Eligibility and transfer restrictions apply.

AREA CONVERSION

Thai land measurement units

Thai listings commonly use rai, ngan and square wah, while usable building area is usually shown in square metres.

Quick reference

Use these conversions to compare land sizes consistently. Final area must follow the registered land document and official survey.

1 rai · 1 ไร่ 4 ngan = 400 sq.wah = 1,600 sq.m.
1 ngan · 1 งาน 100 sq.wah = 400 sq.m.
1 sq.wah · 1 ตารางวา 4 sq.m.
1 sq.m. Approximately 10.764 sq.ft.

CITY PLANNING & ZONING ·

Understand the colour before you develop

The colour on a city plan is a starting point—not a construction permit. It indicates the broad land-use category, while the applicable plan, sub-zone code, plot location, road width, building-control law and environmental rules determine what may actually be built.

Low-density residential

Generally intended for lower-density homes and compatible community uses. Restrictions vary by plan and sub-zone.

ORANGE · สีส้ม

Medium-density residential

May accommodate a broader range or greater intensity of residential use, subject to the local plan.

BROWN · สีน้ำตาล

High-density residential

Commonly associated with higher-density urban residential areas; building rights are never determined by colour alone.

RED · สีแดง

Commercial

Broadly intended for commercial and urban activities, with permitted and prohibited uses set by each plan.

PURPLE · สีม่วง

Industrial & warehouse

Used for industrial or warehouse-related purposes in many plans. Environmental and factory regulations may also apply.

GREEN · สีเขียว

Rural & agricultural

Generally prioritises rural or agricultural use. Development can be limited and must be checked carefully.

GREEN / WHITE ·

Rural conservation

Often carries stronger conservation objectives and tighter controls than ordinary rural and agricultural areas.

BLUE · สีน้ำเงิน

Government & public use

Generally designated for government, public-utility or public-interest uses under the applicable plan.

CHECK BEFORE YOU COMMIT ·

Colour alone is not enough.

Check the exact plot in the Department of Public Works and Town & Country Planning's Landuse Plan system, read the map legend and written regulations, then request official confirmation when the intended project, investment or contract depends on the result.

  1. Locate the exact plot
  2. Identify the plan & sub-zone
  3. Read permitted and prohibited uses
  4. Check building and access controls
  5. Obtain professional confirmation

General guide only. Colour names and controls can differ between plans and can change when a new plan takes effect. Always rely on the current official map and written regulations for the exact plot.

FOREIGN OWNERSHIP

Buying property responsibly in Thailand

Foreign ownership rules differ for condominium units, buildings, land, companies and leases. Buyers should obtain independent legal advice before signing or transferring funds.

IMPORTANT NOTICE ·

No nominee ownership arrangements

Parker Estate Agency does not recommend, arrange or support nominee structures intended to circumvent Thai property ownership laws. Foreign buyers should obtain independent advice from a qualified Thai lawyer before entering into any ownership, company or long-term lease arrangement.

REGISTERED PROPERTY RIGHTS

Sap-Ing-Sith

A registered right—not property ownership

Sap-Ing-Sith is a legally registered right to use and benefit from another person's immovable property under Thailand's Sap-Ing-Sith Act B.E. 2562 (2019). It does not transfer ownership of the land or property to the right holder.

Every transaction is different

The suitability, duration, transferability, inheritance, financing arrangements and permitted use must be reviewed according to the registered documents and the circumstances of each transaction.

Independent legal review is essential ·

Before entering into a Sap-Ing-Sith arrangement or making any payment, both parties should appoint qualified Thai lawyers to review the ownership documents, registration conditions, agreement, tax implications and protection of their respective rights.
